Mobile application and website terms of services apply to all transactions with third party payment processors.

THE SERVICES PROVIDED THROUGH THIRD PARTY PAYMENT PROVIDERS ARE PROVIDED “AS IS” WITHOUT REPRESENTATION OR WARRANTY, WHETHER IT IS EXPRESS, IMPLIED, OR STATUTORY. WITHOUT LIMITING THE FOREGOING, WE SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We are not responsible for delays caused by third-party payment providers. Your use of the mobile application, and any third party payment providers are governed by the pump.fun terms of use and any terms of service or terms of use of the payment providers, including, without limitation, binding arbitration clauses which may limit your ability to redress grievances in court or participate in class action lawsuits.

You may be required to create an account with any third party payment provider you use, including by providing all required KYC or other screening information to such provider. We make no promises or guarantees regarding the suitability of any particular third party payment provider with respect to any particular user.

Our relationship with any third-party payment processing vendor is merely contractual in nature, and such third-party payment processor in no way subject to our direction or control. Thus, such relationship is not, and should not be construed as, one of fiduciaries, franchisors-franchisees, agents-principals, employers-employees, partners, joint venturers, contractors, or the like.

You are not required to use any third party payment provider to use our app, however, if you choose to use such provider, then you must share your payment information with such third-party payment processing vendor(s) and this financial information is subject to the terms of service and privacy policies of such provider.

You are responsible for all amounts that accrue under your account(s) with any third-party payment processing vendor(s) which you choose to use. You also agree to be responsible for all payments, fines, penalties and other liabilities incurred as a result of payments that you authorize or accept through any third party payment processor, including, without limitation, all fees, penalties, taxes and duties; and to be responsible for all expenses (including costs and reasonable outside attorney fees) and interest incurred by any such person or entity to collect any overdue amounts. You agree to indemnify and hold us harmless from and against any such amounts that we may be held liable for.

We reserve all rights to recoup any damages which we suffer as a result of your access to third party payment processors through our mobile applications, including but not limited to any losses which we suffer as a result of fraudulent or false chargebacks.
